- Definitions

“Seller”, “we”, “us”, “our”: TITANLITH BATTERY AND ACCESSORIES PRIVATE LIMITED
“Buyer”, “you”, “your”: Any individual or entity purchasing Products from the Website or in-store
“Products”: Goods listed for sale online or sold through our physical store
“3PL / Carrier / Courier”: Any third-party logistics provider engaged to transport goods. - Scope & Acceptance of Terms
These Terms & Conditions (“Terms”) govern all sales conducted through the Website as well as direct sales from our physical store.
By accessing the Website, placing an order (online or offline), or making payment, you agree to be legally bound by these Terms and our Privacy Policy.
- Customer Categories
We supply Products to both:
Business customers(B2B), and
Individual consumers
Nothing in these Terms shall limit any non-excludable statutory rights available under applicable law.
- Product Information & Availability
While we strive to ensure accuracy, product specifications, images, and availability may change without prior notice. Minor variations shall not be treated as defects or non-conformity.
- Pricing, Taxes & Incoterms
All prices are quoted Ex-Works (EXW) from the Seller’s warehouse.
Prices are exclusive of GST, duties, freight, insurance, and handling charges, unless expressly stated.
We reserve the right to correct pricing errors and cancel affected orders with a refund. - Orders, Acceptance & Cancellation
Orders placed by the Buyer constitute an offer.
Acceptance occurs only upon written confirmation or dispatch of goods.
We reserve the right to cancel orders due to stock unavailability, pricing errors, compliance issues, or suspected fraud.
Buyer cancellations:
May attract processing/restocking charges.
Custom or special-order items are non-cancellable.
- Payment Terms
100% advance payment is mandatory before dispatch.
Orders will be processed only after full and cleared funds are credited to our bank account.
Important Conditions:
UTR, screenshots, or payment confirmations are not valid proof of payment.
Any delay, failure, or reversal by banks/payment gateways is the Buyer’s responsibility.

NEFT / RTGS / IMPS
UPI / Net Banking
Payment Gateway
Cash (within limits prescribed by Indian law)
TDS / TCS:
Applicable taxes shall be handled as per Indian tax laws.
Buyer must inform applicability before making payment.
All bank and transaction charges shall be borne by the Buyer.
- Delivery, Shipping & Risk Transfer
All sales are on EXW basis.
Risk transfers to the Buyer upon:
Pickup from our warehouse, OR
Handover to Buyer’s courier
If shipment is arranged by us:
We act only as a facilitator/booking agent
Delivery timelines are indicative only
Risk remains with the Buyer
No insurance is provided unless explicitly arranged by the Buyer.
- Title & Ownership
Ownership of goods transfers only after full payment realization. Until then, goods remain the property of the Seller.
- Buyer Responsibilities (Address & Compliance)
The Buyer must ensure:
Accurate billing and shipping details
Correct GSTIN and compliance data
Any penalties, delays, or legal consequences due to incorrect information shall be solely borne by the Buyer.
- Inspection & Short-Quantity Claims
Goods must be inspected at delivery.
Any damage or tampering must be recorded at delivery time.
Shortage Claims Requirements:
Continuous unboxing video (mandatory)
Submission within 12 hours via WhatsApp
Supporting photos and documents
If validated, we will either:
Supply missing items, OR
Issue a proportional refund
- Transit Damage or Loss
The Seller is not responsible for:
Transit damage
Loss
Delay
Misdelivery
All such claims must be handled directly with the courier or insurer.
- Returns & Replacements
Returns are not accepted, except:
Verified short shipment
Wrong item dispatch
Approved returns must:
Be unused
Be in original packaging
Be returned within 7 days
Be sent at Buyer’s cost
- Warranty Disclaimer
Products are sold “as-is”
No warranty (express or implied) is provided
Buyer is responsible for testing and suitability - Technical Advice
Any technical guidance provided is for reference only and does not constitute a warranty or guarantee.
- Use & Legal Compliance
The Buyer is responsible for:
Safe handling and storage
Legal usage and resale
Compliance with applicable laws (including battery regulations, EPR, etc.)17. Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect or consequential damages
Total liability is limited to the amount paid for the product
- Force Majeure
We are not liable for delays or failures caused by events beyond our control (natural disasters, strikes, government actions, etc.).
- Intellectual Property
All website content is owned or licensed by the Seller and protected under applicable laws.
- Account Security
Users are responsible for maintaining the confidentiality of their account credentials and activities.
- Privacy
Personal data is handled in accordance with our Privacy Policy.
- Third-Party Services
We are not responsible for the actions or failures of third-party service providers such as couriers or payment gateways.
- Indemnity
The Buyer agrees to indemnify the Seller against any losses arising from:

Courts in Aligarh (U.P.) shall have exclusive jurisdiction.
